Lindsay Lohan Arrested for Leaving Scene of an Accident

TMZ UPDATE: Surveillance video at The Dream hotel in NYC shows the guy who claims Lindsay Lohan struck him is grossly exaggerating his claim at the very least, TMZ has learned.

Sources connected to the hotel tell TMZ that the video shows the entire incident and the aftermath.  Lindsay was driving into the hotel, down a ramp.  The alleged victim was walking in the pedestrian path, which Lindsay had to cross.

The video shows Lindsays car, which is traveling at a crawl, getting very close to the pedestrian but its unclear if the vehicle makes contact.  In fact, sources tell TMZ that 2 detectives came to the hotel early this morning and viewed the tape.  One detective felt Lindsays car "grazed" the back of the alleged victims leg, but the other detective felt the car never made contact.

And it gets better.  Once Lindsay clears the area and goes down a ramp, the video shows the alleged victim sprinting after her.  The video shows the alleged victim does not get real close to Lindsay, and it doesnt appear that he confronted her, but it appears when he got down there he noticed it was Lindsay, partly because she had drawn a crowd near the entrance to the club.

When Lindsay gets out of the car at the bottom of the ramp, she does not seem flustered or aware she may have hit someone.

Heres where it gets confusing.  For some reason, Lindsay decided to leave the club minutes after arriving, got back in her car and left for a short time, then came back.

Meanwhile, the alleged victim called 911 and was taken to the hospital by ambulance.

UPDATE: According to TMZ, Lindsay is telling friends she had no idea she hit anybody and it wasnt until she came out and got arrested that she knew anything was going on.

As for the story about one of the passengers in her SUV getting out of the car and checking for damages, she says it never happened. Nobody ever got out of the car.

Lohan is calling the incident "really fishy" because the man didnt appear to have any visible injuries and feels shes the victim of a set up. Shes not going to let the incident go and is planning on fighting it to the end

(TMZ) --  Lindsay Lohan was arrested for leaving the scene of an accident this morning after allegedly clipping a pedestrian in downtown Manhattan, TMZ has learned.

Law enforcement sources tell TMZ, Lindsay was pulling in to park her Porsche Cayenne near the Dream Hotel in downtown NYC when, at a very low speed, she allegedly hit the knee of a 30-something year old guy. That was around 2AM ET.

Were told one of Lindsays passengers in the SUV got out and checked the car for damage, and then LiLo and co. went inside the hotel. 

Were told someone called police while Lindsay was inside, and when she walked out of the hotel -- around 2:30AM ET -- officers arrested her.

According to TMZ, Lindsay was booked for leaving the scene of an accident, a misdemeanor, and then released with a desk appearance ticket - meaning she did not have to pay bail before release.

TMZ reports alcohol was not involved.

TMZ is also reporting that the alleged victim was actually hospitalized, however, he was not knocked down or dragged and didnt have any visible injuries.

This arrest could absolutely trigger a probation violation in Lindsays jewelry theft case because one of the conditions of probation is she OBEY ALL LAWS. 

Even without a conviction, Judge Stephanie Sautner, the judge in the jewelry theft case, could haul Lindsays butt into court if theres probable cause to believe she committed a crime.
