  4. Contest Name: AMERICAN TOP 40 WALT DISNEY WORLRD® FLYAWAY SWEEPSTAKES (the “Contest”).
  5. Premiere Radio Networks, Inc., its subsidiaries and affiliated companies (together, “the Company”), will conduct the Contest substantially as described in these Official Rules, and by participating, each participant agrees as follows:
  6. 1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest begins at 12:01am Pacific Time on May 28, 2005 and concludes at 11:59:59pm Pacific Time on June 3, 2005. Online entries limited to one entry per person per day. Subsequent entries from a person on any single day will not be eligible for prizes. Contest winner will be drawn from online entries. By entering, entrants acknowledge compliance with the Official Rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. The Walt Disney Company, American Top 40 with Ryan Seacrest, Premiere Radio Networks, Inc., (together, the “Participating Sponsors”) will not be responsible for technical or human errors in transmission of, or receipt of, telephone calls and/or miscommunication, as well as for technical or human errors in omission, interruption, deletion, defect, delay in operation or transmission, theft, destruction, unauthorized access to, or alterations of, entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Company on account of technical problems, any form of active or passive filtering of any kind, insufficient space in entrant’s e-mail account to receive e-mail messages or traffic congestion on the Internet or at any website or any combination thereof. The Company is also not responsible for injury or damage to entrant’s or any other person’s computer related to or resulting from, playing, downloading or submitting any materials in the Contest. The Company reserves the right to cancel or modify the Contest if fraud, technical failures, or any other causes beyond the control of the Company, compromise the integrity of the Contest as determined by the Company in its sole discretion. No mechanical reproductions will be accepted with the exception of entries via the www.at40.com home page. The use of automated software or computer programs to register or enter the Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. Entries void if defective, altered, forged, illegible, or received outside authorized channels. All entries and information become property of the Company and will not be acknowledged or returned.
  7. 2. ENTRY DETAILS: To enter, visit http://www.at40.com and follow all instructions to become a Countdown Key Holder, including completing the online entry form and submitting your name and e-mail address.
  8. 3. PRIZE SELECTION DETAILS: A random drawing will be held on or about June 6, 2005 from among all eligible entries received by 11:59:59pm Pacific Time on June 3, 2005. Odds of winning depend on the number of eligible entries received. Winner agrees to be bound by these Official Rules and the decisions of an independent judging organization, whose decisions are final and binding. Winner will be notified by telephone and/or mail on or about June 6, 2005. An Affidavit of Eligibility and Liability/Publicity Release must be signed, notarized, and returned by prize winner or winner's parent/legal guardian if winner is a minor in his/her state, within fourteen (14) days of notification attempt. Travel companion (guest) of the prize winner, or their parent or guardian if guest is a minor, must complete a Liability/Publicity Release prior to issuance of travel documents. Prize will not be awarded unless the foregoing Affidavits and Releases are timely completed and returned. Failure to return the executed Affidavits and Releases within that time may result in forfeiture of prize and random selection of alternate winner from remaining eligible entries. Except where prohibited by law, by accepting any prize, prize winner and travel companion (guest) consents to the use of his/her likeness, photograph, name, or voice for advertising and publicity purposes in any and all media worldwide (including winners list) for American Top 40 with Ryan Seacrest, The Walt Disney Company and the Company without additional compensation or notification.
  9. 4. PUBLICITY; USE OF PERSONAL INFORMATION: By participating, where allowed by law, all participants and winner(s) grant the Company and Participating Sponsors exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Contest and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, and only to the extent permitted by the Company’s Privacy Policy, participants agree that the Company and Participating Sponsors may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
  10. 5. PRIZE(S): The prize(s) that may be awarded to the eligible winner(s) are: One (1) Grand Prize winner will win a trip for four (4) to Walt Disney World® Resort. The trip includes round trip coach airfare for four (4) people from the major gateway nearest the winner’s home to the major gateway nearest Orlando, FL, three (3) night hotel accommodations (quad occupancy), four (4) four (4) day Park Hopper® passes valid for admission to EPCOT®, MAGIC KINGDOM® Park, DISNEY’S ANIMAL KINGDOM® Theme Park, and Disney-MGM Studios, two-hundred and fifty Disney Dollars ($250.00) (one Disney Dollar equals one US dollar, redeemable at the WALT DISNEY WORLD® Resort) and voucher for ground transportation between airport and hotel . (Approximate Retail Value: $3,700.00). Travel must take place by May 12th, 2006 and is based on hotel availability at the WALT DISNEY WORLD® Resort. Winner and guest must travel out of the same airport and on the same itinerary. Minors must be accompanied by a parent or legal guardian. Certain travel restrictions and blackout dates may apply. Participating Sponsors, in their sole discretion, reserve the right to provide ground transportation and one (1) one-hundred dollar ($100.00) gas card in lieu of air transportation if the winner resides less than 125 miles from the prize destination. Meals, incidentals, alcohol, gratuities, souvenirs, phone calls, and all other expenses not specifically mentioned herein are the sole responsibility of the winner. Participating Sponsors reserve the right to substitute any portion of this prize, including destination and travel dates, for an alternate prize of equal value. No transfer or change of the prize is permitted except at the sole discretion of the Participating Sponsors. Unclaimed prize will not be awarded. Other restrictions may apply. All federal, state, and local taxes on the prize are the sole responsibility of the prize winner.
  11. 6. TAXES: Any valuation of the prize(s) stated above is based on available information provided to the Company and Participating Sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. Winner must provide the Company and Participating Sponsors with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
  12. 7. CONDUCT AND DECISIONS: By participating in the Contest, participants agree to be bound by the decisions of the Company’s personnel. Persons who violate any rule, engage in improper conduct, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and the Participating Sponsors are final. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTEST PARTICPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NATURE’S CURE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
  13. 8. CONDITIONS. Entrants release the Company, The Walt Disney Company, American Top 40 with Ryan Seacrest, their respective directors, employees, divisions, affiliates, officers, subsidiaries, agents, advertising agencies and all others associated with the development and execution of the program, from and against any and all liability with respect to or in any way arising from this Contest and the awarding and use of the prize, including liability for personal injury.
  14. 9. ELIGIBILITY. Participants and winner(s) must be legal continental U.S. residents and be at least 18-years old as determined by the Company. A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but the Company reserves the right to refuse to award a prize to or on behalf of any minor. Only one (1) prize per household for the Contest. Individuals who have won a prize from American Top 40 or AT40.com within 180 days (6 months) prior to the start date of this Contest are NOT eligible. Employees of the Company, the Contest’s Participating Sponsors and their divisions, affiliates, officers, affiliated companies, subsidiaries, agents and advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Subject to all laws and regulations and void where prohibited or restricted by law. Contest void in Rhode Island.
  15. 10. MISCELLANEOUS: Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. The Company may substitute prizes, amend the rules or discontinue the Contest at any time. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to American Top 40 Walt Disney World® Flyaway Sweepstakes, P.O. Box 80,000, Los Angeles, CA 90080-1000. Winner’s name will be available for six (6) months beginning July 6, 2005. VT residents only may omit return postage. All entries become the property of the Company and will not be returned or acknowledged
